Press Files First Amendment Lawsuit Against South Dakota

From the Rapid City Journal, CNN, Fox News and The Associated Press have filed suit against South Dakota.

They want to do exit polling within 100 feet of polling places in the June 3 primary, but SDCL 12-18-3 prohibits it.

The lawsuit, filed Monday, alleges that a state law barring exit polls or public opinion polling within 100 feet of a voting location violates the First Amendment.

The suit wants to bar South Dakota Secretary of State Chris Nelson and Attorney General Larry Long from stopping such activity.
