Idaho Passes Health Freedom Act Protecting Against Govt Health Care
According to Yahoo News, Idaho became the first state to fully pass a measure protecting its citizens from the unconstitutional government health care plan Democrats in congress are hell-bent on passing. Some 37 other states are also working on similar legislation. One has to wonder if the rogue socialists in Washington D.C. give a whit about what the American people think anymore.
From the Idaho State Journal, Governor C.L. “Butch” Otter said the legislation he signed is a clear expression from his state that the people of Idaho value their state sovereignty.
“Congress and the White House are working out their scheme for pushing through a healthcare ‘reform’ bill that has more pages than the U.S. Constitution has words. I guarantee you that not a single member of the House or Senate has a complete understanding of that legislation any more than they understood all the implications of the USA PATRIOT Act back in 2001,” Governor Otter said. “What the Idaho Health Freedom Act says is that the citizens of our state won’t be subject to another federal mandate or turn over another part of their life to government control.”
South Dakota had three such bills in the legislature this year. Unfortunately, two of the three were voted down in committee, but a third was supported by both the state House and Senate.
The resurgence of states asserting their rights under the Tenth Amendment over the past year has been heartening after so many years of the federal government treating the states like servants to take care of the “small stuff” that was beneath their lordly attention.
If the socialists in the federal government are paying any attention at all, they’ve been getting the shock of their lives as we’ve seen the Tea Party movement explode from among the American people over night, with town halls on fire with patriotic fervor and states rallying against federal intrusion where the U.S. Constitution forbids it.
And if they succeed in ramming through this health care assault on the freedom and rights of the American people, they’re in for an even bigger cold bucket of reality to hit them in the face on Election Day this November.

I'm sorry, Bob, but this is a phenomenally stupid idea. How would you feel if a blue state like Vermont or California passed a law exempting them from something Republicans in Congress had passed, like a tax cut or nation-wide abortion ban or something? If states can suddenly ignore any federal law they want, that will lead to anarchy and the destruction of the country.
I believe this is stretching the 10th amendment farther then it was intended to go and I also think it's unAmerican. I pray South Dakota doesn't follow in Idaho's footsteps.
I know you liberals think the Constitution is stupid, but I'd really be neat if you could understand how important this document is to our freedom and the well being of our nation.
If Republicans in congress passed something unconstitutional like government health care, I'd be among the first to applaud Vermont or California in passing a law exempting themselves from it–then get on our guys here to do the same.
The states can't ignore “any federal law they want.” Laws that lack constitutional authority as this one does (check Article 1 Section 8, and the Tenth Amendment) are not laws; they are not legally binding on a mangy dog, much less any of the states.
Rather, you should be outraged that this rogue congress is ignoring the U.S. Constitution–and egregiously violating their oath as they do so.
To ignore the United States Constitution, the highest law of our nation–THAT is the very defintion of un-American.

Liberals don't think the Constitution is stupid. We strongly support the Constitution. We just have a different interpretation of some parts of it than conservatives like you do. You believe your interpretation is the correct one just like we believe our interpretation is correct. I disagree with you that this health care reform would be unconstitutional. I believe the members of Congress need to pass it because it would be a good thing for our country. And I know you disagree with me on that and on my interpretation of the Constitution.
Where there are such strong disagreements about the Constitution we can turn to the Supreme Court. One of the purposes of the Supreme Court is to sort out the varying interpretations of the Constitution. Right now there are five activists conservative Justices on the Court, so they'd probably agree with your interpretation.
So, from what you just posted, you'd be okay with Vermont and California excluding themselves from a federal law because you assume that law would be against your interpretation of the Constitution. But what about something that liberals think is unconstitutional but you don't? Like were you okay with the Patriot Act that became law under President Bush? A lot of liberals thought it was unconstitutional and took it to the Supreme Court. So would you have been okay with some blue states making laws excluding themselves from the Patriot Act? Personally, I would have just as much of a problem with that as this Idaho law.
I think the proper way to test if a law is constitutional or not is through a lawsuit against the government and try to take the case to the Supreme Court because they have the power to decide what is constitutional or not. I think it's bad for individual states to decide which federal laws they don't have to follow because that would be chaos and damage our system of government.
I have a small correction to what I just posted. I hadn't read the Idaho law itself, just what you wrote in this blog about it. I thought it was some kind of shield law that said Idaho is somehow exempted from the health care reform bill.
But the Idaho law actually directs their AG to sue the federal government if this health care reform passes. That's actually what I think people should do if they believe a bill is unconstitutional. So even though I disagree with them about this bill being unconstitutional, they're at least correct on the process.

You liberals think you can just ignore the constitution when it gets in the way of your glorious socialist revolution.

The proper way to “test” if a law is constitutional is to read the constitution, see if it is in harmony with the Constitution (usually by reading Article 1 Section 8 to see if the federal government has authority to legislate in that area), and if it isn't, don't pass the stupid bill–in fact, don't even submit it and waste everyone's time in the first place. This bill never should have been submitted in the first place because it was clearly not authorized in Article 1 Section 8.
They have little choice at this point but to go that route, since the majority in congress has shoved their fingers in their ears and their fists in their eyes, refusing to abide by the Constitution.
This contemptuous disregard for our Constitution and the rights of the American people simply has to stop–and stop completely–if our republic is going to survive much longer.
