Judge: Abortionists Must Tell Women Abortion Terminates a Human Life

Women seeking an abortion must be told that the procedure ends a human life, a federal judge ruled Thursday, upholding part of a South Dakota law.

U.S. District Judge Karen Schreier said doctors must disclose to pregnant women that “the abortion will terminate the life of a whole, separate, unique, living human being.”

But she rejected other portions of the state’s 2005 informed consent law that required doctors to tell women that abortion increases the risk of suicide and that they have “an existing relationship with that unborn human being.”

“A legal relationship requires two people. The United States Constitution does not recognize an unborn embryo or fetus as a ‘person,’ in the legal sense,” Schreier stated.

Assistant Attorney General John Guhin praised the ruling, commenting, “I think the most important part of the statute has been upheld.”

Leslee Unruh, founder of the Alpha Center pregnancy counseling center in Sioux Falls, plans to appeal the judge’s decisions on the suicide and relationship disclosures but still sees the overall ruling as a major step for the pro-life cause.

“This is the unraveling of Roe [v. Wade],” Unruh told The Associated Press. “We take the human being part and go to the Supreme Court and put the human relationship in. That knocks out Roe v. Wade.”

Planned Parenthood Minnesota, North Dakota, South Dakota filed a lawsuit against the state in 2005, alleging that the language in the law was “ideologically charged” and unconstitutional.

The informed consent law was blocked by Schreier from going into effect until the U.S. Court of Appeals for the Eighth Circuit lifted the preliminary injunction in July 2008.

Planned Parenthood called Schreier’s latest decision a “major victory” despite the judge’s decision to uphold the “human being” portion of the law.

Just weeks before this week’s ruling, the state Department of Health sent Planned Parenthood a notice warning that South Dakota’s only abortion clinic could lose its license and be shut down. Health officials said the wording of the clinic’s disclosure form must match the language required by the informed consent law.

Sarah Stoesz, CEO of Planned Parenthood Minnesota, North Dakota, South Dakota, said the clinic will submit a plan Monday on how the clinic intends to comply with the 2005 law.

Meanwhile, the Department of Health will review the judge’s decision and implement it, Guhin said.

“We’ve taken the view, at least with regard to the human being disclosure, that since the 8th Circuit ruled they’ve been obligated to comply, which is over a year ago,” he said, according to AP.

    Gee, so abortion providers have to tell part of the truth that they don't want to have to tell. The point being that the truth is not to the advantage of the “pro-choice” side! Folks, if someone has to hide things from you, they don't deserve your support. Why is that so hard to understand?

    Even by their own logic, “pro-choicers” can only justify about 1 percent of the abortions that take place. It would be a good start to only let abortionists perform (and make $ off of) that 1 percent.

    Seems like this is the government intervening between a doctor and a patient, Thought that's exactly what you are against. Since it is a cause you care about, doesn't that make it a double standard

    Ahem. Conservatives are not against ALL government; we are not anarchists. We recognize there is a distinct but minimal role for government.

    What is that role? I believe Thomas Jefferson summed it up best: “The care of human life and happiness, and not their destruction, is the first and only object of good government.”

    If government will not defend innocent human life from destruction, nothing else it does is of any account.

    Of course we don’t know what Jefferson thought was human life. Did he think an 1 day old embryo was a human life? Couldn’t find any references on that, so while the quote is magnificient, it can’t be specifically related to Jeffersons views on abortion and life.

    My real concern is the poor mother-to-be who fits the catagory of if the procedure isn’t done, her life will be in great danger. She is probably going to deal with the guilt her entire life, especially if she is Pro-Life. Now we have the government forcing the physician to tell her that she will be ‘ terminating the life of a whole, separate, unique, living human being ‘ Then the lawmakers wanted to make the doctor tell the mother that her risk of suicide is greater and that she had an existing relationship with her soon to be truly medically indicated, aborted child. I don’t like the government in health care.

    The abortion business has become so profitable that any thing that would reduce them is painful to the abortionists. Imagine making a living on killing human beings in what has become the most dangerous place for them, their mother's womb. Planned Parenthood (a misnomer if I ever heard one), was established for population control of the unwanted, disabled and inconvenient people, especially the poor. What does that really say about the state of humanity at this juncture. Pretty sad. Obama is the perfect president to lead us further into the abyss. Maybe it is our collective fate.

    We've been over this before: it's pretty darn clear to anyone who doesn't have an agenda to destroy inconvenient human life that the unborn child IS human life from conception on.

    So it really doesn't matter what Jefferson THOUGHT about a 1-day-old human embryo; the science speaks for itself (again, to anyone who doesn't have a convenience-agenda).

    The “poor mother-to-be” whose “life may be in danger” is also nothing more than an excuse. Statistics show the overwhelming majority of abortions are done purely for convenience. Here in South Dakota, our Dept of Health tracks the reasons for abortion: about 84% of them are done because “the mother did not desire to have the child.” Wow. Real danger there. Only 1.7% are done to avoid serious health issues…and there is little dispute about those, especially ones where the mother's life is truly in danger.

    Again, the first and foremost duty of government is to protect innocent human life.
