Court Rules in Favor of Christian Child's Freedom of Speech
According to AP's "Judge: District can't ban student speech" by WILLIAM KATES, Associated Press Writer (April 2, 2007), "A school district violated a fourth-grader's constitutional rights to free speech and equal protection by refusing to allow her to distribute "personal statement" fliers carrying a religious message, a federal judge has ruled." The article goes on to say, "The Liverpool Central School District in upstate New York based its restrictions on "fear or apprehension of disturbance, which is not enough to overcome the right to freedom of expression," Chief U.S. District Judge Norman Mordue wrote in a 46-page decision Friday." How the school district is merely in fear of reaction to Christian statements and fliers, one can only wonder. Why do they think freedom of speech only applies to non-religion, anti-religion and satanic messages? Just as one has the right to say they do not believe in God -- another should have a right to show they do. To ban all acknowledgement and suggestion of God in public is a censor that strips away constitutional rights and makes freedom of speech nothing more than a phrase tossed around that actually has no meaning. Kates goes on to report, "The court cannot say the danger that children would misperceive the endorsement of religion is any greater than the danger that they would perceive a hostility toward religion as a result of the district's denial," Mordue wrote. Perhaps this ruling will be a step back towards common sense!
