South Dakota
Abortion Ban - Who Voted For It, Who Didn't
HB 1215 passes SD Senate 23-12
By Bob Ellis
Dakota Voice
HB 1215 to
ban most abortions in South Dakota passed the Senate today in a 23-12 vote.
The bill had passed the state House two weeks ago in a 47-22 vote.
The bill now goes back to the House for reconciliation due to a slight
change to the bill introduced by the Senate:
Moreover, the
Legislature finds that the guarantee of due process of law under the
Constitution of South Dakota applies equally to born and unborn human
beings, and that under the Constitution of South Dakota, a pregnant mother
and her unborn child, each possess a natural and inalienable right to life.
The change does not alter the essential meaning of the bill.

After reconciliation between the state Senate and House,
the bill will then go to Governor Mike Rounds for consideration.
Rounds rejected a similar bill two years ago because of fears that South
Dakota's existing abortion restrictions might be nullified during the
certain court battle for the law. However, supporters say those
concerns have been addressed in this bill.
